数学在法律中的应用

数学不仅在天文、物理、化学等自 然科学领域,而且在经济、历史、政治等
社会科学领域都得到了成功的应用。本文着重论述的是数学应用 于法律领域的历
史状况、一般方法、相关数学分支及典型例证。首先,本文在一至三部分分别考
证了近代以前、近代和现代国外法律领域数学应用的历史状况,其中,重点介绍了
现代国外法律领域数学 应用的三个主要方面——法的经济学分析中的数学方法、
《法律的运作行为》中的数学命题和法律问题的 博弈分析。其次,本文在第四部
分介绍了法律领域数学应用的一般方法——数学建模,论述了五个常见的 应用于
法律领域的相关数学分支——初等数学、概率论与数理统计、运筹学、模糊数学
和集合论 ,并通过五个具体例证分别说明了Q值法、相关分析、线性规划、模糊
选择、集合运算等数学方法在法律 领域的应用过程。最后,本文在第五部分介绍
了我国法律领域数学应用的历史状况,其中,重点介绍了我 国现代法律领域数学应
用的发展,并分析了我国法律领域数学应用的国际地位、原因及其对策等内容。

Mathematics has many successful applications not only in the field of natural
sciences such as astronomy, physics, chemistry, but also in the field of social sciences
such as economics, history, politics, and so on. In this article, I elaborate the history
status, the general method, the correlative branches of mathematics and the typical
illustrations about mathematics applied in the field of y, from section one to
section three, I research respectively the history of
mathematical applications in the field of foreign law in different periods, from the
recent times before, to the recent times and to the modern times. In these sections, I
