it is further agreed that in order to be entitled to the said payments ( the fi
rst one excepted, which is otherwise secured ), party a or its legal representa
tives shall, according to the architects appraisement, have expended, in labor
and material, the value of the payments already received by party a, on the bui
lding, at the time of payment.

上述协议如未能忠实执行,则违约一方 同意其应享有权利自动丧失,且在违约之日后一个月
之内,向对方或其法定代表赔偿人民币_____元 整,作为商定之损失赔偿费。

for failure to accomplish the faithful performance of the agreement aforesaid,
