It is obvious that the accident was due to the fact that the derrick was overloaded by a

Collision report

While the above-named vessel was lying properly moored alongside No.5 Berth, at
about

hours
on
22
nd

November,
1977,
the
S.S.‖
EVELPIS

Greek
flag,
port
of
registry Piraeus, which was shifting from her berth, drifted and struck the portside of my
vessel, causing damage to the bulwark, stanchions, etc.
This accident was caused by careless maneuvering
on the part of the S.S,‖evelpis‖
during NW wind without tug assistance.

Such
being
the
case,
I
hold
the
S.S.
―EVELPIS‖
responsible
for
the
aforesaid
damage and other damage which may have been caused to the hull below the waterline
on account of this accident.
